Alexandria Brain Injury Lawyer

Alexandria, VA Brain Injury Attorneys

A traumatic brain injury can alter the course of a person's life permanently — their personality, their memory, their ability to work, and their relationships. Unlike a broken bone that heals on a predictable timeline, the consequences of a brain injury are often unpredictable, progressive, and lifelong. If you or someone you love has suffered a brain injury due to another party's negligence, the compensation you pursue needs to reflect that reality — not just the immediate hospital bill.

At Antezana & Antezana, LLC., our Alexandria brain injury attorneys have been handling serious injury cases since 2001, and in 2025 alone we recovered more than $70 million in settlements and verdicts for our clients across Virginia and Maryland. We understand what these cases require — medically, legally, and personally — and we have never accepted a settlement that doesn't account for the full scope of what our clients have lost.

Every attorney and staff member on our team speaks both English and Spanish fluently. When a brain injury affects the whole family, clear communication isn't a luxury — it's essential.

What Is a Traumatic Brain Injury?

Traumatic brain injuries occur when a sudden trauma — a blow, jolt, or penetrating injury to the head — disrupts normal brain function. They range widely in severity:

  • Mild TBI (including concussion): Temporary loss of consciousness, confusion, headaches, memory problems, and sensitivity to light or noise. Symptoms may not appear immediately and are often dismissed — by insurance companies and sometimes by medical providers — as minor. They are not always minor.
  • Moderate TBI: More extended loss of consciousness, cognitive difficulties, physical impairment, and behavioral changes that can last weeks, months, or permanently.
  • Severe TBI: Extended unconsciousness or coma, permanent cognitive and physical disabilities, and in the worst cases, a vegetative state. Survivors often require lifelong care.

Even a "mild" TBI can cause lasting cognitive, emotional, and physical consequences that affect a person's ability to work, maintain relationships, and live independently. Insurance companies frequently exploit the perception that concussions are minor injuries to limit payouts. We push back on that aggressively.

Common Causes of Brain Injuries

Brain injuries in personal injury cases most commonly result from:

  • Car, truck, and motorcycle accidents — the force of impact, even without direct head contact, can cause the brain to strike the inside of the skull
  • Slip and fall accidents — particularly dangerous for older adults and on hard surfaces
  • Construction and workplace accidents — falling objects, falls from height, and equipment failures
  • Medical malpractice — oxygen deprivation during surgery, anesthesia errors, or failure to diagnose and treat a brain bleed
  • Bicycle and pedestrian accidents — where the victim has little or no protection from impact
  • Violent crimes and assaults — which can form the basis of a civil claim separate from any criminal proceedings

Regardless of the cause, if another party's negligence or recklessness contributed to the injury, you have the legal right to seek full compensation.

Why Brain Injury Cases Are Especially Difficult to Prove

Brain injury cases are among the most complex in personal injury law for several reasons — and understanding those challenges is part of how we build stronger cases.

  • Delayed symptom onset. Symptoms of a TBI sometimes don't appear until days or weeks after an accident. Insurance companies use this gap to argue that the injury wasn't caused by the incident, or wasn't serious. We work with medical experts who understand the neuroscience and can connect the injury to the accident with precision.
  • Disputed medical causation. Defense attorneys and insurers frequently hire their own experts to challenge the severity of a brain injury or its connection to the accident. Our attorneys know how to counter these arguments with the right medical evidence and expert testimony.
  • Invisible injuries. Unlike a broken bone visible on an X-ray, many brain injuries don't show up clearly on standard imaging. Neuropsychological testing, functional MRI, and other assessments are often necessary to document the true extent of damage. We know which evidence matters and how to present it.
  • Virginia's contributory negligence rule. Virginia is one of the few states where being found even 1% at fault can bar a victim from recovering any compensation. In brain injury cases — particularly those involving car accidents or falls — insurers will look for any opportunity to assign partial blame. Our attorneys build cases from the start specifically to prevent that.

A Note to Family Members

If your loved one has suffered a severe brain injury, they may not be able to advocate for themselves. You may be the one making decisions about their care, their finances, and their legal options. We work directly with families in exactly these situations — explaining every step of the process clearly, in English or Spanish, and ensuring that the legal strategy reflects the full lifetime impact of the injury, not just the immediate costs.

You don't have to navigate this alone. We're here to handle every aspect of the case while you focus on supporting your loved one's recovery.

What Compensation Can You Recover?

Brain injuries often involve the highest long-term costs of any personal injury case. A settlement that only covers immediate medical expenses can leave a family financially devastated years later. We calculate and pursue compensation for the full picture, which may include:

  • Emergency and acute medical care
  • Ongoing neurological treatment and rehabilitation
  • Occupational, speech, and physical therapy
  • Lifetime care costs for severe injuries
  • Lost wages during recovery
  • Permanent reduction in earning capacity
  • In-home care or assisted living costs
  • Pain and suffering
  • Emotional distress
  • Loss of enjoyment of life
  • Loss of consortium for spouses and family members
  • Wrongful death damages when a brain injury proves fatal

Insurance companies will almost never volunteer these categories. We make sure nothing is left on the table.

What to Do After a Head Injury

If you or someone you love has suffered a blow to the head in an accident:

  1. Seek medical attention immediately — even if symptoms seem minor. Delayed treatment can worsen outcomes and creates gaps in documentation that insurers exploit. Insist on a neurological evaluation.
  2. Follow all medical advice and attend every follow-up appointment. Gaps in treatment give insurers ammunition to argue that your injury wasn't serious or that you failed to mitigate your damages.
  3. Document everything. Keep records of every symptom, every medical visit, every medication, and every way the injury is affecting your daily life. Journals documenting cognitive and behavioral changes can be powerful evidence.
  4. Don't accept any settlement offer without legal counsel. Initial offers in brain injury cases almost never reflect the long-term costs. Once you accept a settlement, you typically cannot pursue additional compensation later — even if your condition worsens.
  5. Call us before speaking to the insurance company. What you say in those early conversations can significantly limit your recovery. We're available 24 hours a day, 7 days a week.
