Types of Compensation Available in Slip & Fall Cases

You can pursue both economic and non-economic damages in a slip and fall case. Economic damages refer to the objectively quantifiable financial losses you have sustained and will continue to sustain because of your injuries. Non-economic damages account for the subjective and intangible consequences of the accident. Maryland law places a cap on the amount of non-economic damages you can receive, but we always work to maximize your recovery within the limits of the law.

Our slip and fall lawyers can fight to get you full and fair compensation for all of your economic and non-economic damages, including:

  • Medical expenses
  • Lost income and earning capacity
  • Property damage
  • Pain and suffering
  • Emotional distress
  • Loss of enjoyment of life

When Do I Have a Slip & Fall Case?

Not every fall leads to liability. Legitimate accidents happen, and property owners and managers are not expected to guarantee absolute safety. However, you likely have a slip and fall case and can pursue compensation if we can establish that the property owner or manager acted negligently.

Specifically, we need to be able to demonstrate the following legal elements:

  • Duty of care. The property owner or manager owed you a duty to keep the premises reasonably safe. The extent of this duty can vary depending on why you were on the property and whether you had permission to be there.
  • Breach of duty. The property owner or manager failed to uphold this duty by failing to sufficiently address a dangerous condition.
  • Causation. This specific dangerous condition directly caused your fall.
  • Damages. You suffered actual physical and/or financial harm as a result.

It is not enough to show that a hazard existed and caused your fall. We must also be able to show that the property owner or manager knew or should have known about it.

The property owner or manager is likely liable if they saw the hazard or received a report about it but failed to address the danger before the slip and fall occurred. They may also be liable if the hazard existed for a long enough period that a reasonable property owner or manager would have discovered and addressed it during routine inspections.

Our experienced team at Antezana & Antezana, LLC. understands what it takes to win these cases. We can review your circumstances and determine whether you have a strong claim at no cost to you.
