Elements of a Maryland Negligent Security Claim
Negligent security law may hold an owner or operator accountable for failing to use ordinary care against foreseeable criminal activity, even when a third party committed the crime.
A claim generally requires evidence of four legal elements:
- Duty: The person or entity responsible for the property owed the injured person a duty of care.
- Breach: The responsible party failed to provide security measures that were reasonable under the circumstances.
- Causation: The security failure contributed to the circumstances in which the attack and resulting harm occurred.
- Damages: The injured person sustained an actual injury or other compensable loss.
How Foreseeability Affects Responsibility
Foreseeability concerns whether the risk of criminal activity was reasonably predictable. Evidence may include prior similar crimes on the property, warnings about a known dangerous individual, or events immediately preceding the attack. Reports of broken gates, repeated unauthorized entry, or earlier security complaints may also show what the responsible party knew.
Liability doesn’t arise automatically whenever a crime occurs. The facts must connect a foreseeable danger and inadequate precautions to the injury. A jury may weigh the risk created by the security conditions against the burden of addressing that risk.
Compensation in a Negligent Security Case
A negligent security claim may seek compensation for losses caused by the assault, subject to the evidence and applicable Maryland law. Economic damages can include medical expenses, lost income, and other documented financial losses. Compensation for non-economic harm can address pain, emotional distress, and loss of enjoyment of life.
Maryland caps non-economic damages in personal injury cases, with the applicable limit determined by law. Documented financial losses aren’t subject to the same type of cap. The value of a claim depends on the injuries, available documentation, fault disputes, and the connection between the security failure and the attack.
We offer free consultations to discuss the incident, conditions at the property, and available records. Virtual meetings are available, and we provide personalized attention throughout the representation. We have recovered more than $752 million on behalf of clients, although every case depends on its own facts.
