Am I Eligible for Workers’ Compensation in Maryland?
Understanding eligibility for benefits can be confusing. You may qualify for workers’ compensation benefits if you suffer a work-related injury, including a repetitive stress injury, or develop an occupational disease. Not all workers are eligible for workers’ compensation, however, and not all injuries entitle you to benefits, either.
Generally, you are eligible for workers’ compensation if you meet the following criteria regarding your employment status and the nature and cause of your injury:
- You were classified as a "covered employee." Most employers in Maryland are required to carry workers’ compensation insurance. Furthermore, most employees working in Maryland qualify from their first day of employment, including part-time and seasonal staff. Employers sometimes misclassify staff as independent contractors, who do not qualify, to avoid paying insurance premiums. In these scenarios, we can scrutinize your actual work conditions, such as who sets your hours and provides your tools, to demonstrate your legal status as an employee.
- Your injury arose out of your employment. A direct link must exist between your job duties and your injury or illness. This means the harm must result from a hazard specific to your work environment. We can gather evidence to demonstrate that your work activities directly caused your medical condition and counter any claims that a pre-existing issue is to blame.
- The accident happened in the course of employment. This standard looks at the time, place, and circumstances of the incident. You typically qualify if the injury occurred during work hours, on company premises, or while performing work-related tasks off-site. While the law generally excludes regular commutes, we can investigate for exceptions, such as those that may apply when running errands for your boss or driving a company vehicle.
- You sustained an injury regardless of fault. When it comes to workers’ compensation, Maryland operates under a no-fault system. You do not need to prove your employer acted negligently, nor does your own mistake disqualify you from receiving benefits. Unless the injury resulted from willful misconduct or intoxication, you typically remain eligible for compensation regardless of fault.
Every situation is different, and exceptions may apply to your unique circumstances. We encourage you to reach out and learn more about your rights and legal options, even if your employer claims you are not entitled to benefits.
Understanding the Role of Third-Party Personal Injury Claims
Some workplace accidents involve negligence by someone other than your employer or a co-worker. In these scenarios, Maryland law permits you to file a personal injury lawsuit against the negligent third party alongside your workers' compensation claim. This is critical because while workers' compensation covers medical bills and lost wages, it does not compensate you for pain and suffering and other non-economic damages. A third-party claim can.
Our team at Antezana & Antezana, LLC. includes experienced personal injury attorneys. If you have a strong third-party personal injury claim, we are prepared to manage both forms of legal action simultaneously to maximize your financial recovery.
You don’t have to go through the process of seeking benefits alone. If you need help with your workers’ compensation claim, call or contact us online now.
